Prelim investigation of 'Hayden cam' case moved to July

Only Katrina Halili and Dr. Hayden Kho Jr., with their lawyers, went to the Department of Justice on Friday for the preliminary investigation of the complaint filed by the actress against the cosmetic surgeon.

Due to the absence of other respondents and witnesses, Senior State Prosecutor Emily Fe Delos Santos set a clarificatory hearing on July 14 where everyone is required to be present.Halili had filed a case against Kho for violation of the Anti-abuse of Women and Children Act in connection with the uploading of their sex video on the Internet and distribution in DVD stalls.

An anxious-looking Halili arrived at 2 p.m. while Kho entered the hall while she was being sworn in.

Erik Johnston Chua, Dr. Herbert "Bistek" Rosario, and Princess Marie Velasco - whom Halili had included in the case - failed to submit counter affidavits and only sent their lawyers.Also absent were witnesses Omar Sortijo, Halili's road manager, and Jo-anne Maglipon, editor-in-chief of Yes! magazine.

Dr. Vicki Belo, who is also accused of spreading the controversial videos, was not present during the proceedings. She arrived with her lawyer after Halili and Kho had left the DOJ.

Halili sues Belo, Kho for medical malpractice

Katrina Halili filed a affidavit of malpractice of cosmetic surgery against Vikki belo and Hayden Kho. Base in the affidavit that was passes by Katrina at PRC states that Hayden passed the Medical Board Examination and registered with the Professional Regulation Commission on February 27, 2007. And as admitted by Hayden in his affidavit, after passing the Board Exam for just merely 6 months, Hayden have performed liposuction on Katrina, with the date that he gave, sometime in August 2007.

For the said period of six months, Hayden could not have acquired the needed residency, training, and specialization before he could qualify as a cosmetic surgeon authorized to perform cosmetic surgery especially liposuction procedure on any patient, including Katrina. Hayden should have undergone general surgery residency training for a period of four years with a hospital accredited by the Philippine College of Surgeons.

After the said four-year period of general surgery residency training, with specialty board certification, Hayden should also attend and complete another two years of training for cosmetic surgery, specifically for liposuction. During the said two-year training period, Hayden could apply as a member of the Philippine Society for Cosmetic Surgery, and during this period also, the respondent should pass written and oral examinations. It is only after passing the said examinations that the respondent could be called a Diplomate.

Hayden also has the option to practice for another two years for cosmetic surgery to become a Fellow, and one of the requirements of being a Fellow is to have at least fifty (50) cases of cosmetic surgery.

Hayden now has the burden of proof to establish that he possessed all the qualifications, training, and specialization to practice cosmetic surgery, more particularly liposuction. Hayden now has to prove that he attended and passed all the written and oral examinations required of him in order to specialize in his chosen field-cosmetic surgery.

Katrina also filed against Dr. Belo for allowing Hayden Kho to perform ng cosmetic surgery, particulaly to Katrina, wherein his residency, training, and specialization has not yet completed. base also in the complaint Dr. Belo cannot feign ignorance on the lack of qualification, training, and specialization of Hayden as a 'cosmetic surgeon' since he only passed the Medical Board Examination sometime in February 2007 and the liposuction surgery on Katrina was done in August 2007. Thus, the Commission should also sanction and/or penalize respondent Dr. Belo to serve as a deterrent to others who might follow the practice of Dra. Belo and how Belo Medical Group, Inc. toleate this act and both should be administratively found liable and guilty of malpractice of cosmetic surgery and their license to practice medicine be revoked.

Hayden's ex-pal drops by NBI, denies uploading sex videos

The businessman who allegedly uploaded the videos of Dr. Hayden Kho Jr. having sex with different women went to the National Bureau of Investigation (NBI) headquarters to deny the accusations against him.

Eric Johnston Chua, a former friend of Kho's, dropped by the NBI’s Anti-Fraud and Computer Crimes Division (AFCCD) office at about 3:30 p.m. to file his affidavit and answered all allegations. He told the reporters that he have nothing to do with the uploading of videos after a closed-door meeting with NBI officials led by Palmer Mallari, executive officer of the NBI-AFCCD.

Chua refused to divulge the contents of his affidavit.The NBI is investigating the scandal based on the complaint filed by actress Katrina Halili, who was in one of the sex videos. She said the video was taken and uploaded without her consent.

During last week’s Senate investigation on the scandal, Kho named Chua and another former friend, Dr. Mark Herbert “Bistek" Rosario, as the ones who uploaded the scandalous videos. He said he had a falling out with the two, and that vendetta could be the motive behind the action.

Chua said he had gone to the NBI almost a dozen times but added that they were not about the sex video case but in in connection with my piracy license, which is another matter.

The NBI had already subpoenaed Rosario, who is reportedly working at the Makati Medical Center. NBI-AFCCD chief Vicente de Guzman III said the transcript of the Senate hearing would form vital part of bureau’s ongoing probe.

Both Kho and Halili were present during the investigation by the Senate Committee on Youth, Women and Family Relations under Sen. Ma. Ana Consuelo “Jamby" Madrigal.

Actress Katrina Halili has tested negative for drug use as tested by the Philippine Drug Enforcement Agency (PDEA)Halili's legal counsel, Raymund Palad, told reporters that his client submitted a urine sample to the PDEA.Halili’s ex-lover and sex video partner, cosmetic surgeon Hayden Kho, underwent a drug test at the PDEA by submitting a urine sample.

PRC summons Hayden Kho

The Professional Regulation Commission (PRC) on Friday released a summon order for Doctor Hayden Kho, currently enmeshed in a sex video scandal.

The order came a day after sexy actress Katrina Halili – one of the three women seen in separate video recordings having sex with Kho – filed a complaint against the doctor seeking to revoke his medical license.

However, radio dzBB reported that a team from the PRC’s Legal and Investigation Division failed to serve the summon order because the doctor was not in his condominium unit in Makati City when authorities came.

Kho has already issued an apology which Halili thought was insufficient. The sexy actress said the doctor should still face sanctions for the covert recording of his sexual encounters.However, Kho had already offered to give up medical practice for good.

On the other hand, the National Bureau of Investigation had issued a subpoena for Kho, girlfriend Dr. Vicki Belo, and fraternity brother Dr. Eric Johnston Chua.

According to the Optical Media Board, Chua was the one who leaked the sex video recordings on the Internet. The NBI subpoenaed Chua to make comment on this claim.
